BEING A RESOL®TION OF THE CITY
COUNCIL OF THE CITY OF CAMPBELL
AUTHORIZING THE CITY ATTORNEY TO
UNDERTAKE REMOVAL OF MOVED-ON
STRUCTURE
WHEREAS, the City entered an agreement with Michael
Lindsay on May 22, 1987 to allow a structure to be moved on to
1162 Steinway (hereinafter referred to as "the property") prior
to obtaining the legally required permits;
WHEREAS, the agreement provided that if Mr. Lindsay did
not diligently pursue all necessary permits, the structure would
be forfeited to the City, and could be removed;
WHEREAS, Mr. Lindsay has still not obtained a final
inspection for his building permit, and has continuously
maintained an illegal use on the property;
NOW, THEREFORE, BE IT RESOLVED as follows:
1. The City Council finds that Michael Lindsay has
failed to pursue finalization on his building permit with
reasonable diligence, and has willfully impeded his own progress
by maintaining an illegal use on the property;
2. Michael Lindsay is hereby directed to either (a)
discontinue all illegal uses on the property and obtain a final
inspection on his building permit within the next thirty (30)
days or (b) remove all structures from the property within said
thirty (30) day period;
3. If Michael Lindsay fails to comply with section 2
of this Resolution, then the City Attorney is authorized to treat
the structure as forfeited, and cause it to be removed, with the
costs of removal to be placed as a lien against the property.
Passes and adopted this 16 day of April, 1991 by the
following vote:
