CC Resolution 8026RESOLUTION N0. $026 BEING A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL, APPROVING A PLANNED DEVELOPMENT PERMIT, PLANS, ELEVATIONS, DEVELOPMENT SCHEDULE AND CONDITIONS OF APPROVAL TO ALLOW CONSTRUCTION OF 4 TOWNHOMES ON PROPERTY LOCATED AT 875 APRICOT AVENUE, APPLICATION OF MR. KURT ANDERSON, IN A PD (PLANNED DEVELOPMENT) ZONING DISTRICT, PD 90-04. After notification and Public Hearing as specified by law on the application of Mr. Kurt Anderson, for approval of a Planned Development Permit, plans, elevations, and development schedule to allow the Construction of 4 townhomes, on property located at 875 Apricot Avenue; and, after presentation by the City Staff, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the City Council did find as follows: 1. The proposal is significantly less dense than permitted in the General Plan. 2. The proposal provides 13 parking spaces for a ratio of 3.25 spaces per unit. 3. The proposal provides sufficient setbacks from the existing structures to the east to ensure adequate lights and air. 4. The building massing has been reduced and rearyard setback increased to reduce impacts on surrounding development. Based upon the foregoing findings of fact, the City Council further finds and concludes that: 1. The proposed development and uses clearly would result in a more desirable environment and use of land than would be possible under any other zoning classification; and 2. The development and uses would be compatible with the General Plan of the City and will aid in the harmonious development of the immediate area. 3. The proposed development will not result in allowing more residential units than would be allowed by other residential zoning districts which are consistent with the General Plan designation of the property; and 4. The proposed development would not be detrimental to the health, safety, or welfare of the neighborhood or of the City as a whole. Resolution No $026 page two Based upon the above findings, the City Council of the City of Campbell does hereby approve the Planned Development Permit by adopting the attached Exhibit A, entitled Plans and Elevations; Exhibit B, entitled Development Schedule; Exhibit C, entitled Map of Said Property; and Exhibit D, entitled Conditions of Approval, as per the application of Mr. Kurt Anderson for plans, elevations, and development schedule to allow the construction of 4 townhomes, in a Planned Development Zoning District. Copies of Said Exhibits are on file in the Planning Department.
