CC Resolution 7966RESOLUTION N0. 7966 SECOND AMENDMENT TO AGREEMENT TO PROVIDE LOCAL LAW ENFORCEMENT AGENCY ACCESS TO THE CALIFORNIA IDENTIFICATION SYSTEM WHEREAS, the County and the City of Campbell have entered into an agreement dated April 26, 1988, entitled AGREEMENT TO PROVIDE LOCAL LAW ENFORCEMENT AGENCY ACCESS TO THE CALIFORNIA IDENTIFICATION SYSTEM" (hereinafter "Original Agreement"), in order to fund, implement and operate a local automated fingerprint identification system (hereinafter "Local ID System"), which will provide local law enforcement agencies with direct access to the California Identification System (herein "CAL-ID System") through the use of local remote access network equipment (hereinafter "Local RAN Equipment"); and WHEREAS, the County and the City of Campbell desire to continue the Original Agreement and to modify its terms with respect to the financial contribution which the County and the Incorporated Cities will each make to the City of San Jose in order to implement and operate the Local ID System and to extend the term of the Agreement for another year. NOW THEREFORE, in consideration of the mutual promises and benefits, the County and the City of Campbell agree that the Original Agreement be amended as follows: 1. Section 2 of the Original Agreement, entitled "TERM", is amended to read in full as follows: The term of this Agreement shall commence upon the date of execution of this Agreement by all parties and shall terminate on June 30, 1991, unless terminated earlier as provided herein. It is anticipated that the parties will renew this Agreement beyond June 30, 1991, by an express written amendment. 2. As required under Section 6.C .3. of the Original Agreement, a list setting out the operating budget for fiscal year 1990-91 and reflecting the financial contributions of each party to the Agreement for fiscal year 1990-91 operating costs of the local ID System is attached as Exhibit "A". Page 2 3. This Second Amendment may be executed in one or more counterparts, each of which shall be an original, but all of which together shall constitute one and the same document. 4. All other terms and conditions of the Original Agreement remain in full force and effect.
