CC Resolution 7931RESOLUTION N0. 7931 BEING A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL AGREEING TO PARTICIPATE IN A CONGESTION MANAGEMENT PLANNING AGENCY FOR SANTA CLARA COUNTY WHEREAS, the State of California enacted into law AB 471 (Katz), Chapter 106, July 10, 1989, and SB 300 (Kopp), Chapter 105, July 10, 1989, and AB 1791 (Katz), Chapter 16, March 12, 1990, which, upon the passage of Proposition ill on June 5, 1990, requires the development, adoption, implementation and enforcement of a county-wide Congestion Management Plan and the designation of an overseeing Congestion Management Planning Agency for the development of a long-term, comprehensive transportation program; and WHEREAS, eligibility for over $600 million in transportation funding for Santa Clara County and its cities is dependent on passage of Proposition 111 and the designation of a Congestion Management Planning Agency, and conformance to a Congestion Management Plan; and WHEREAS, in order to meet the requirements of the State legislation and to be eligible for new transportation funding, the Cities and the County have expressed an interest in creating a CMP Agency if the California voters approve Proposition 111; and WHEREAS, the Cities and the County have reviewed, discussed and worked cooperatively with a broad-based consensus to develop a proposal for the creation of a CMP Agency. NOW, THEREFORE, BE IT RESOLVED that the City of Campbell agrees to participate in the Congestion Management Planning Agency as set forth in Attachment A, upon the passage of Proposition ill. Fadness, Chair Santa Clara County Transportation Commission 1550 Berger Drive San Jose, CA 95112 Dear Chairs McKenna and Faaness: On behalf of the Campbell City Council, I am responding to your letter of February 8 regazding the proposed structure for a Santa Clara County Congestion Management Agency. The Campbell City Council considered this proposal at its meeting of March 20, 1990. The Council appreciates the significant effort that went into developing this joint proposal. As you are aware, we have previously been concerned about an appropriate communication and consensus building process regarding this issue. We believe that great strides have been made over the last several weeks to have such a dialogue. This process must continue in order to build an appropriate consensus regarding this very significant issue. While not completely satisfied with many elements of the proposal, the Campbell City Council can support the proposed "joint proposal" if several significant remaining issues can be addressed. The position of the Council on this issue is as follows: o Whatever mechanism is developed should emphasize eazly communication and consensus building between affected jurisdictions prior to formal deliberations/decision-making regarding proposed projects. o While not completely satisfied with the suggested voting structure, the City will no longer oppose the proposed voting structure, recognizing that amendmeAts•have been made partially addressing Campbell's concerns. o If Proposition 111 is not successful, the role and responsibilities of the proposed agency should be completely re-evaluated recognizing that the currently suggested roles and responsibilities are modeled after an assumed legislative mandate and were not specifically designed to create an appropriate organizational structure and process for Santa Clara County and its cities- Chairs McKenna and Fadness March 21, 1990 Page 2 o If Proposition 111 is not successful, the assumed funding source for this new "Congestion Management Agency" will not be available. We are concerned that since the administrative costs associated with the proposed agency have not as of yet been identified, that substantial costs for operating the agency could be shifted to cities possibly requiring the allocation of General F1ind revenues. Our support of the concept should in no way be considered a commitment of existing City resources to as yet undefined operating costs. o A procedure for amendment/abolishment of the Agency should be included in the proposal. With the appropriate resolution of these remaining questions, I feel confident that a strong county-wide consensus regarding the creation of a Congestion Management Agency can be achieved.
